YOU AGREE TO BE BOUND BY THE CHRISTIANCINEMA "USER AGREEMENT" BY USING THE CHRISTIANCINEMA WEB SITE.

ChristianCinema is a world wide web site owned and operated by ChristianCinema.com, Inc.. (hereafter referred to as "ChristianCinema"). By accessing any areas of ChristianCinema, users ("Users") agree to be legally bound and to abide by the terms and conditions set forth herein (the "User Agreement").

By electronically submitting an order via the ChristianCinema web site, User is agreeing to be bound by all of ChristianCinema current terms and conditions related to the rental of ChristianCinema products. A user's ChristianCinema order will not be confirmed or processed unless User consents to be bound by the terms and conditions. The terms and conditions shall be governed and interpreted by the laws of the State of California, without regard to conflicts of law principles.

Membership
As a subscriber to ChristianCinema, you agree that we are permitted to charge your credit card a monthly subscription fee, any applicable sales tax and any other charges you may incur in connection with your use of ChristianCinema. The subscription fee will be billed at the beginning of your subscription and on each monthly renewal date. All fees and charges are nonrefundable. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email. If you want to use a different credit card or if there is a change in your credit card validity or expiration date, you may edit your credit card information by clicking on the "My Account" button.

Your ChristianCinema subscription will be automatically renewed on a monthly basis. For your convenience, we will charge the monthly subscription fee to the credit card you provide to us during registration (or to a different credit card if you change your account information). Your membership will automatically renew for successive monthly subscriptions, without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews in order to avoid billing of subscription fees to your credit card. Your subscription will remain open and active and your credit card will continue to be billed even if ChristianCinema is temporarily unable to satisfy the number of monthly rentals you are entitled to with your subscription because of the unavailability of titles. For example, if with your subscription you are entitled to five movies, and for some reason ChristianCinema is only able to send you four at a time for any given month, your credit card will be billed the full amount appropriate to your subscription level for that month.

You may cancel your membership at any time by notifying us at dvdsupport@christiancinema.com and you will not be charged for any additional months. There are no refunds for any months already billed or paid for. For example, if you paid on August 5th and you canceled your membership on Oct. 20, then you would not be charged on Nov. 5 (for the Nov. 6 – Dec. 5 period) and your membership would expire on Nov. 5 because you had not yet been charged on Nov. 5 (for the Nov. 6 – Dec. 5 period). If you canceled on Oct. 2, then your membership would expire Oct. 5 because you had not yet been charged for the Oct. 6 – Nov. 5 period. If the Credit Card is no longer valid or expires or for any reason will not accept charges for subsequent monthly membership fees, your account will be placed on hold and you will not be able to rent additional movies until your Credit Card information is updated. You can update your Credit Card information online or by contacting our customer service department at dvdsupport@christiancinema.com.

If you do not return an outstanding DVD rental within seven (7) days after the expiration of your membership term, you authorize ChristianCinema or its agents to charge your Credit Card the Manufacturer’s Suggested Retail Price for any and all such outstanding movies. For example, if you registered on June 5 and you canceled your membership on January 20, any movies rented through the service must be postmarked no later than February 6 and received by us no later than February 13.

Applicant acknowledges that he/she has received and read a copy of these terms and conditions for ChristianCinema membership and agrees that the membership will be used only as provided in such User Agreement. ChristianCinema reserves the right, at any time and without notice, to amend the Terms and Conditions of membership. Applicant agrees that ChristianCinema and its affiliates may pursue all avenues of collection, including use of collection agencies, and authorizes ChristianCinema and its affiliates to prepare and submit credit card charge using any of the charge cards listed above to recover all charges and all other unpaid amounts due to (a) Applicant's failure to timely return all items rented through the membership, (b) damages to returned items (not to exceed the retail price of the item), and (c) other unpaid charges and reasonable legal fees resulting from the failure to return rented items.

Any rented item not returned within 7 days after the expiration of your membership term may, at the option of ChristianCinema, be converted from a rental to a sale. Member is responsible for the Manufacturer’s Suggested Retail Price as shown on ChristianCinema.

ChristianCinema and its affiliates may share and use personally identifiable information collected from you during registration and membership sign up, or generated by use of the membership to develop and improve the products, benefits and services they or selected business partners offer to members. ChristianCinema and its affiliates also may share and use certain member data in the ordinary course of their business, for example, for account maintenance and debt collection.

ChristianCinema membership is not transferable. You must be 18 years of age for ChristianCinema membership.

We reserve the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever.

Reliance on Information
This site may include publications with technical inaccuracies or typographical errors that may be corrected as they are discovered at ChristianCinema sole discretion. Also, changes are periodically made to the information contained herein.

ChristianCinema may make modifications, improvements and/or changes to these Terms and Conditions; ChristianCinema membership terms and conditions, privacy policies, the information, names, text, software, images, pictures, logos, trademarks and other materials displayed on or contained in ChristianCinema site; or the products and services referred to within, with or without notice. Such modifications, improvements and/or changes shall be effective immediately upon posting. ChristianCinema site may contain links to or references to other web sites. The information, names, images, pictures, logos and trademarks that can be accessed may originate outside the boundaries of the ChristianCinema site. ChristianCinema shall have no obligation or responsibility regarding any content derived, obtained or accessed within, through or outside ChristianCinema own site. You agree not to add, alter, substitute or amend partially or in whole any information, software or other materials displayed on or contained in the site.

ChristianCinema Online Rights
ChristianCinema may elect to electronically monitor the User submit areas and may disclose any Content, records or electronic communication of any kind (i) to satisfy any law, regulation or government request, (ii) if such disclosure is necessary or appropriate to operate ChristianCinema, or (iii) to protect the rights or property of ChristianCinema, its Users, Sponsors, Providers, Licensors or Merchants.

ChristianCinema is not responsible for screening, policing, editing, or monitoring such Content. If notified of allegedly infringing, defamatory, damaging, illegal or offensive Content, ChristianCinema may investigate the allegation and determine in its sole discretion whether to remove or request the removal of such Content from ChristianCinema.

ChristianCinema reserves the right to prohibit conduct, communication, or Content which it deems in its sole discretion to be harmful to individual Users, ChristianCinema, the communities which make up ChristianCinema, or any rights of ChristianCinema or any third party, or to violate any applicable law. Notwithstanding the foregoing, neither ChristianCinema nor its Providers, Merchants, Sponsors, or Licensors can ensure prompt editing or removal of questionable Content after online posting. Accordingly, neither ChristianCinema or its Affiliates, or any of their respective officers, directors, employees, or Agents nor, Provider, Merchant, Sponsor or Licensor shall assume liability for any action or inaction with respect to conduct, communication, or Content on ChristianCinema.

Proprietary Rights
User acknowledges that ChristianCinema contains information, data, software, photographs, graphs, digital video discs, videos, typefaces, graphics, music, sounds and other material (collectively "Content") that are protected by copyrights, trademarks, trade secrets or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. All Content is copyrighted as a collective work under the U.S.

Copyright laws and ChristianCinema owns a copyright in the selection, coordination, arrangement and enhancement of such Content. User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from or in any way exploit, any of the Content, in whole or in part. If no specific restrictions are displayed, User may make copies of select portions of the Content, provided that the copies are made only for User's personal use and that User maintains any notices contained in the Content, such as all copyright notices, trademark legends or other proprietary rights notices. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see e.g. 17 U.S.C. Section 107), User may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other propriety right. In addition to the foregoing, use of any software Content shall be governed by the software license agreement accompanying such software.

You further agree that you will not disassemble, decompile, reverse engineer or otherwise modify the Materials.

These Terms and Conditions will be governed by, construed and enforced in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Disputes arising here from are in the first instance exclusively subject to the jurisdiction of United States courts located in Visalia, California.


Acceptable Use
Registration. In providing information to ChristianCinema, you agree to provide true, accurate, current and correct information about yourself, and (b) to maintain and update your registration information to keep it true, accurate, current and complete. If ChristianCinema has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ChristianCinema has the right to suspend or terminate your account and refuse any and all current of future use of your ChristianCinema membership (or any portion thereof).

In using this site you agree that you will not: (a) post, disseminate or transmit unauthorized advertising, promotional materials, chain letters, junk mail or any other type of unsolicited mass email to people or entities who have not agreed to be part of such mailings; (b) omit, delete, forge or misrepresent transmission information, including headers, return mailing and Internet protocol addresses, or otherwise manipulate identifiers to disguise the origin of any content; (c) impersonate any person or entity, or falsely state or otherwise misrepresent an affiliation with any person or entity; (d) engage in any activities intended to withhold or cloak identity or contact information; (e) send harassing and/or threatening messages to others; (f) post excessive (20 or more copies of the same article in a 45-day period) or repeated off-topic articles to newsgroups; or (g) engage in 'flooding', i.e., ICMP flooding and mail bombing (sending large amounts of email repeatedly to the same email address).

ChristianCinema.com, Inc. reserves the right to change these Terms and Conditions anytime but will alert members to the changes in advance.

These Terms represent the entire understanding relating to the use of the Website and prevail over any prior or contemporaneous, conflicting, or additional, communications.
